Agreement to terms

These Terms & Conditions ("Terms") govern your access to and use of https://fortuneconsulting.io (the "Site") operated by Fortune Consulting Inc. ("Fortune Consulting", "we", "us", or "our"). By accessing the Site or submitting an application, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

Who we are

Fortune Consulting is a marketing systems, automation, and business education company. We provide training, coaching, and done-with-you systems to help individuals build and grow marketing agencies. We do not offer a business opportunity, get-rich-quick scheme, or income guarantee.

Application process

Submitting an application through the Site does not create a client relationship or entitle you to admission into any program. All applications are subject to our review, and we may accept or decline any application at our sole discretion. You agree that the information you provide in your application is accurate and complete to the best of your knowledge.

Programs, payments, and investment

Participation in our programs requires a monetary investment, which will be disclosed to you and agreed upon in a separate agreement before any payment is collected. Program access, deliverables, and scope are defined exclusively in that separate agreement, which controls over these Terms in the event of a conflict. Unless otherwise stated in that separate agreement, program fees are non-refundable once access has been granted.

No earnings or results guarantee

Any results, revenue figures, or case studies presented on the Site or in our materials reflect the experiences of select clients and are not typical. Your results depend entirely on your own work ethic, skill, decision-making, market conditions, and effort. We make no guarantee that you will achieve any particular financial outcome, secure any clients, or earn any income. Nothing on the Site constitutes financial, legal, or professional advice.

Intellectual property

All content on the Site and in our programs — including videos, training material, frameworks, copy, graphics, logos, and trademarks — is the proprietary property of Fortune Consulting or its licensors and is protected by intellectual property and copyright law. You may not duplicate, reproduce, record, redistribute, resell, or share our material without our prior written permission. Violation may result in termination of access and legal action.

Testimonials and student interviews on the Site reflect real experiences of individuals who used our systems; results are not typical and are not a promise of your results. If you provide a testimonial, interview, or feedback, you grant us a perpetual, worldwide, royalty-free license to use your name, likeness, voice, and statements in our marketing.

Third-party platforms

Our programs may reference or integrate third-party platforms and services (such as Instagram, Skool, or CRM tools). We do not own or control those platforms, are not affiliated with or endorsed by them, and are not responsible for their availability, policies, or actions. Your use of third-party platforms is governed by their own terms.

Disclaimer of warranties

The Site and all content are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by law, Fortune Consulting and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenue, or business opportunities, arising from or related to your use of the Site or our programs. Our total aggregate liability for any claim will not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Fortune Consulting from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

Termination

We may suspend or terminate your access to the Site or any program at any time, with or without cause, including for violation of these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, liability limits, and dispute resolution) will survive.

Dispute resolution

These Terms are governed by the laws of the United States and the state in which Fortune Consulting Inc. is incorporated, without regard to conflict of law principles. Before pursuing formal action, the parties agree to attempt to resolve any dispute in good faith through direct communication for at least thirty (30) days. Any unresolved dispute will be resolved by binding arbitration or in the courts located in that jurisdiction, and you consent to their personal jurisdiction. You waive any right to participate in a class action against us.

Changes to these terms

We may update these Terms from time to time. The "Last updated" date above shows the current version, and your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
